Terms and Conditions
1.1 The Web store terms and conditions (the “Terms”) are applicable for all legal relations, offers, sales and deliveries between the customers (the“Customer”) and framedbykarl.com (the “Web store”) run by Karl Disain OÜ (the“Framed by Karl”), reg. code 12124457, address Telliskivi 57, Tallinn 10412, Estonia.
1.2 In addition to the terms and conditions, the legal relations arising as a result of purchasing the products from the Web store are regulated by applicable legislative acts of Estonian Republic.
1.3 Framed by Karl has the right to change the terms and conditions. All the changes will be published online on the framedbykarl.com website and will come into effect immediately after their publication. Using the site or by placing an order the customers agree to be bound by the terms and conditions.
1.4 Customers can order unique wooden frames (the“Products”) from the Web store that are specially made for the Customer according to the measurements provided by the Customer. Considering the fact that the frames are made as a special order, the consumer right to withdrawal of the contract in 14 days, does not apply.
2. Prices
2.1 Prices in the Web store are stated in euro (€) and include Value Added Tax (VAT).
2.2 The prices include shipping costs. Framed by Karl is shipping worldwide.
2.3 If the customer orders Products for delivery outside of the EU please note that the customer’s purchase may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by the customer. Framed by Karl recommends the customers to find out the possible import duties and taxes before ordering the Product.
2.4 Framed by Karl has the right to change the prices indicated on website. All the changes will be published online on https://framedbykarl.com website and will come into effect immediately after their publication.
2.5 Should the order be placed before the price change has occurred, the Customer is obligated to pay the price which was in force at the time of placing the order.
3 Orders and Payment
3.1 In order to purchase the Product from the Web store the Customer can choose between the models shown. It is possible to order all the models in 6 different sizes and to choose between 7 different wooden materials. The Product comes together with a box and a polishing cloth for the glasses.
3.2 In order to select the right size the Customer must submit correct measurements. There are two possibilities for taking the measurements: (i) The Customer can print the measurement instruments from the Web store (ii. The Customer can submit their postal address on a Web store application form and Framed by Karl will send the measurement instruments by post. In case the Customer does not complete a purchase in the Web store when ordering the measurement instruments, the cost of the instruments will be added. Together with the measurement instruments the Customer will get a promotional code that the Customer can submit while purchasing the Product and in that case the price of the measurement instruments will be deducted from the price of the Product.
3.3 Together with the measurement instruments the Customer will receive a manual. The Customer is obligated to follow the manual while taking the measurements. When inserting the measurements in the Web store the Customer is responsible for the accuracy of the information.
3.4 The Customer has a choice to order the Product with hinges or without when purchasing from the Web store.
3.5 The Customer may choose whether he wants to order the Product with lenses or not. In case the Customer wants to order the Product together with lenses the Customer shall insert the eye prescription information in the Web store. The Customer is responsible for the information. The lenses are installed by a partner of Framed by Karl.
3.6 In case the Customer wants to order the Product without the lenses, the Customer confirms that he is aware of the fact that it is necessary to follow special instructions while installing the lenses to the Product. Corresponding manual is delivered to the Customer together with the Product. Framed by Karl is not responsible for any damages in case the manual is not followed while installing the lenses.
3.7 It is possible to pay for the Product via the Web store using online banking or Paypal. The Customer must pay for the price in full while performing the purchase.
3.8 The Customer must provide the correct contact information, including the correct postal address where the Product is shipped. Framed by Karl advises the Customer to double-check the billing and shipping information, quick and uninterrupted delivery of the order depends on the accuracy of the info submitted.
3.9 The Product will be delivered within 4 weeks. Framed by Karl will make utmost efforts to deliver the Product on time. Only under special circumstances may Framed by Karl be in the position to not deliver the Product on time. Based on the above, confirmed dates of delivery of the Product shall be understood as informative only. In case the delivery time is extended Framed by Karl will notify the Customer by e-mail.
3.10 This Agreement (the “Agreement”) takes effect from the moment Framed by Karl receives the payment.
3.11 Framed by Karl reserves the right to cancel the Agreement when it is not possible to deliver the products the Customer ordered or one or more products the Customer ordered was listed at an incorrect price due to a typographical error. If Framed by Karl cancels the Agreement the Customer will be notified by e-mail and reimbursed the full sum paid upon placing the order as soon as possible but no later than within 30 days the date the order was placed.
3.12 Framed by Karl has the right to adjust its products offering and thus Framed by Karl will not be obligated to make all or any of products available.
4. Privacy policy
4.1 The Customer hereby gives Framed by Karl the right to use certain personal information. Information that is provided while performing a purchase is collected by Framed by Karl in order to fulfill the Customer order and to develop the service provided to the Customer.
4.2 Framed by Karl may collect the following data: Customer’s name, address, e-mail, phone number, details about the payment, measurement information and eye prescription information.
4.3 Framed by Karl may forward the Customer’s personal information regarding the delivery of the Product to the chosen delivery company.
4.4 Framed by Karl may forward the eye prescription information to the Framed by Karl partner to install the lenses for the Product.
4.5 Customer’s personal information is protected by all security measures required by law. Framed by Karl will not forward the personal information to any third parties, unless it is obligatory under the law.
4.6 The Customer has the right to control all personal information related to the Customer and ask Framed by Karl to change or personal information.
4.7 Framed by Karl may send the Customer special offers, newsletters and questionnaires via the email provided upon placing the order if the Customer agrees to this.
5. Shipping
5.1 The Web store ships worldwide with regular recorded post. Once the order is shipped, Framed by Karl will send the Customer the tracking code so the Customer can follow the journey of the package. Shipping can take up to 7-9 working days for European countries and 21 working days to everywhere else. Framed by Karl is not responsible for any delays or problems that are occurring because of the inaccuracy of the contact information provided by the Customer.
6. Returns & Refunds
6.1 The Products are specially made for the Customer according to the measurements provided by the Customer. Therefore the Customer has the right to withdraw the Agreement and return the Product only under special circumstances. The consumer right to withdrawal of the contract in 14 days, does not apply. If the Customers discovers a defect regarding the measurements or eye prescription, they hold the responsibility to contact Framed by Karl as soon as possible to raise a formal complaint (but no later than 14 days from receiving the Product) by filling in an application form and sending the form to the e-mail address HelpMe@framedbykarl.com.
6.2 Framed by Karl will process the application within 7 days and will contact the Customer to solve the problem and provide the return information. Return costs will be covered by Framed by Karl. A Product that does not follow the guidelines of this Agreement will be fixed/replaced by Framed by Karl.
6.3 The Customer must ensure that the product being returned is unused and, in perfect condition, with all the labels intact. Returns must include the original package in good condition together with the user manual and polishing cloth. New and unused hereby means that there are no marks on the item or any wear on the tags. Web store will not accept any products with any indication of usage. In the aforementioned case, the products will be returned to the customer. The return costs are borne by the Customer.
7. Copyright
7.1 All content available on the Web store, including, but not limited to, text, graphics, logos, images, video and audio clips (the “Content”) is the property of Framed by Karl and is protected by Estonian and international copyright laws.
7.2 It is prohibited to use, reproduce, duplicate, copy, sell, modify, or otherwise exploit the Content in full or in part, for any purpose without making a reference to Framed by Karl.
8. Liability and Force Majeure
8.1 Framed by Karl is not responsible for the damage incurred to the customer as well as product delivery delays, should such damage or delivery delay be caused by circumstances beyond Framed by Karl control, and occurrence whereof Framed by Karl did not foresee and could not have possibly foreseen (Force Majeure).
8.2 Framed by Karl liability connected to any products acquired through the Web Store is strictly limited to the buying price of the products.
9. Warranty
9.1 Framed by Karl provides the Product with a 2 year warranty period. The Product with defects revealed during the warranty period will be replaced or repaired by Framed by Karl without any extra charges.
9.2 The Warranty is not valid in case (i) the lenses are not installed by the partner of Framed by Karl (ii) the defect is caused by the Customer (iii) of normal depreciation of the Product (iv) the material of the Product (wood) is naturally transformed, darkened.
9.3 To use the Warranty the Customer must send an application to e-mail address info@framedbykarl.com. Framed by Karl will process the application within 7 days and will inform the Customer about the return details. Shipping costs are covered by Framed by Karl. When the Product arrives and expertise shows that the Warranty is not valid because of breach of examples in point 9.2 Framed by Karl will inform the Customer immediately and will return the Product to the Customer. In this case the returning costs are borne by the Customer.
10. Governing Law
10.1 All matters not covered by the present terms are to be resolved based on the applicable legislative acts of Estonian Republic.
10.2 All disputes between the Customer and Framed by Karl regarding ordering and buying products from the Web store are to be resolved by negotiations. Should the compromise not be reached, the Parties have the right to turn to the Customer Protection Department or Harju Maakohus (Harju County Court) in order to protect their rights. The Parties shall rely upon the applicable legislative acts of Estonian Republic while resolving disputes.
